ABC's for Virginia Accident Victims
  • ATTEMPT to get the names, addresses, and phone numbers of all witnesses of the accident.
  • BEWARE of the defendant's insurance company and never discuss how the accident happened or what your injuries are with the insurance company.
  • CONFINE any conversation you have with the defendant's insurance company to the property damage sustained in the accident.
  • DISCUSS all matters concerning your case with your attorney before taking any action.
  • EMPLOYERS should be made aware of the fact that you were injured in an accident.
  • FORWARD to your employer any note from your doctor recommending light duties or excusing you from work, making sure your attorney gets a copy also.
  • GIVE any documents (including checks) to your attorney for approval before signing.
  • HAVE photographs taken of any visible damage to your automobile or injury to your body.
  • INFORM your attorney of all doctors you see, all treatment you are receiving, and any time you miss from work.
  • JOURNALS should be kept for and at the request of your attorney, otherwise everything you write can be seen and used against you.
  • KEEP all of your doctors' appointments and explain any unavoidable appointment cancellations.
  • LET both your and the defendant's insurance company know the name of the attorney you have chosen to represent you as soon as possible.
  • MAKE certain that you have informed your doctor and attorney of your entire past medical history so that the defendant and his/her insurance company can not say you kept something from them.
  • NEVER discuss confidential matters about your case with anyone but your attorney or they can be discovered and used against you.
  • OBTAIN a copy of your insurance policy and declarations page that was in effect at the time of the accident and give it to your attorney.
  • PURSUE, through your attorney, any insurance coverage you have been paying for, including Medical Payments, Under Insured Motorist Coverage, and Uninsured Motorist Coverage.
  • QUIT going to treatment only when your body is free of any pain you did not have before the accident and you have discussed your release with your doctor.
  • RELEASES prepared by insurance companies are final - once you accept a settlement and sign the release, you can not reopen the claim again.
  • SAVE all papers and bills related to the accident and your claim in one place for easy reference.
  • TRY to abide by all suggestions and recommendations made by your doctor(s), and inform them of any inability to comply.
  • UNLESS otherwise instructed by your attorney, terminate all discussions with your or the defendant's automobile insurance company after property damage has been resolved.
  • VACATION time at work taken for your injuries is recoverable and should be noted by your employer.
  • WAGE loss must be verified by both your employer as well as your doctors, which is why both should be in communication concerning your missed time for work.
  • X-RAYS and other radiological tests taken since the accident should be revealed to every doctor you see so that these expensive tests will not be needlessly repeated.
  • YOU should never give a recorded statement of any type to any insurance company without your attorney's knowledge, consent, and presence.
  • ZERO will be your settlement or verdict if you are not totally honest and cooperative with your doctors and attorneys.
